ADA access in the public rights-of-way

The Citizen Request Program allows citizens to request improvements in the public right-of-way (curbs, sidewalks, public parking) that will improve access for the community.

Examples of public right-of-way improvements requested can include but are not limited to:

  • Curb ramps: This can include improvements such as reducing existing slopes or adding detectable warning tiles.
  • Sidewalks: This can include improvements such as repairing cracks in the sidewalk that make it difficult to travel over or addressing tree roots or bushes protruding into the walkway.
  • Audible pedestrian signal installation: These improvements provide audible sounds at traffic signals so visually impaired pedestrians know when it’s safe to cross the street.
  • Signalized intersection improvements: These improvements can include relocating pedestrian push buttons so they’re easier to reach or re-aligning the crossings at an intersection.

ADA access in the public rights-of-way grievance procedure

Any person with a disability who believes they have been the subject of disability-related discrimination on the basis of denial of access in the public rights-of-way. This grievance procedure covers access to sidewalks and streets, including crosswalks, curb ramps, street furnishings, pedestrian signals, and other components of public rights-of-way only.

Step 1. Grievance procedure and submission

Please enter the requested information below. The grievance information submission shall be filed with the Department of Public Works within 30 calendar days of the alleged disability-related discrimination.

Step 2. An investigation is conducted

The complainant will be notified within five calendar days of the receipt of the grievance, and if necessary, an authorized City representative will contact the complainant directly to obtain additional facts or documentation relevant to the grievance.

Step 3. A written decision is prepared and forwarded to the complainant

An authorized City representative shall prepare a written decision, after full consideration of the merits of the grievance, outlining the Department of Public Works course of action and expected timeline. This communication shall be sent to the complainant via postal or electronic mail and no later than 45 calendar days following the receipt of the grievance.

Step 4. Appeal to the City Manager

If the complainant is dissatisfied with the written decision, he or she may file a written appeal with the City Manager (915 “I” Street, Room 5000, Sacramento, CA 95814) no later than 15 calendar days of the date of the mailing of the decision. The appeal must contain a statement of the reasons why the complainant is dissatisfied with the written decision and must be signed by the complainant or by someone authorized to do so on the complainant's behalf. The City Manager or his/her representative will act upon the appeal no later than 30 calendar days after receipt, and a copy of the written decision shall be forwarded to the complainant no later than five working days after preparation of the decision.

The Department of Public Works shall maintain the confidentiality of all files and records relating to grievances filed unless disclosure is authorized or required by law. Any retaliation, coercion, intimidation, threat, interference, or harassment for the filing of a grievance, or used to restrain a complainant from filing, is prohibited and should be reported immediately to 311.

Self-evaluation and transition plan (coming soon)

The City’s Public Works Department has undergone a process to update the existing ADA Self-Evaluation and Transition Plan for the Public Right-of-Way. The Self-Evaluation reviewed City’s policies, practices, programs, services, and activities while the Transition Plan identified barriers to access and processes to combine documentation and develop a remediation method for barriers that could prevent the public from using the City’s network of sidewalks and streets.

Unlike a physical building, the network of streets and sidewalks are in a state of constant repair due to external physical and environmental conditions (weather, tree growth, accidents, etc.) which necessitates an innovative approach to ensure pedestrians utilizing the Public Right-of-Way have access to City Programs, Services and Activities.

As part of the Transition Plan update process, public entities are encouraged to allow interested persons the opportunity to provide feedback via a community outreach program. The City encourages you to provide feedback on the Plan by way of a questionnaire. This effort is intended to help the City adjust the Plan prior to adoption and implementation with approval from the City Council.

Other ADA requests and information

The California Department of Motor Vehicles (DMV) issues disabled person parking placards. Visit the DMV’s Parking Placard webpage for more information on requirements for a parking placard, how to request a disabled person parking placard, and the locations where parking placards can be used.

The City of Sacramento cannot respond to matters outside of the City of Sacramento boundary limits. Please contact the city, county, or applicable agency for requests made in those agency jurisdictions.

For requests within private properties such as apartment complexes, privately owned parking lots or, buildings, please reach out to the relevant property owner or property manager.

For requests within Sacramento city limits concerning services the City provides, if there is not an appropriate channel listed on this page, please direct the request to 311 Customer Service.

The City of Sacramento, under Title VI of the Civil Rights Act of 1964 and related statutes, ensures that no person shall, on the basis of race, color, national origin, age, sex, or disability be excluded from participation in, or be denied the benefits of, or be subjected to discrimination under any program or activity receiving federal financial assistance. Any person who believes that they have been discriminated against on the basis of race, color, national origin, age, sex, or disability may file a Title VI complaint with the Department of Public Works. The complaint must be filed within 180 days of the date of the alleged discrimination.
